FRANKFURT (MNI) – A new injunction against the ESM rescue fund in
Germany’s Constitutional Court is challenging whether judges can issue
their initial ruling on the fund as planned on September 12, German
business daily Handelsblatt reported Monday.

A group led by German Professor Markus Kerber has filed a lawsuit
claiming the German Constitutional Court must delay its ruling because
of a similar case filed in the European Court of Justice in Luxembourg,
Kerber’s office confirmed to MNI.

Kerber’s office said the lawsuit is “on its way to the
constitutional court in Karlsruhe”.

Kerber’s lawsuit says the German court must wait until a decision
has been reached in Luxembourg, where an Irish parliamentarian lodged a
complaint against the ESM 10 days ago.
